MMC Golf Cart Purchase Agreement
This Golf Cart Purchase Agreement ("Agreement") is entered into on [DATE], by and between the following parties:
Seller: [SELLER NAME], with a principal business address at [SELLER ADDRESS].
Buyer: [BUYER NAME], with a physical address at [BUYER ADDRESS].
1. Sale of Golf Cart
The Seller agrees to sell, and the Buyer agrees to buy, the described golf cart ("Golf Cart") under the terms in the attached Invoice.
2. Purchase Price and Payment Terms
The total purchase price of the Golf Cart is $[AMOUNT]. This amount represents the final purchase price, inclusive of all applicable taxes, fees, and charges. Payment will be accepted exclusively through a single bank transfer. The Buyer must complete the bank transfer within 5 business days from the date of this Agreement to secure the purchase.
3. Shipment and Delivery
The Seller will deliver the Golf Cart to the Buyer’s address within [DELIVERY TIME] business days of receiving full payment. The Seller will arrange for transportation, and the cost of shipping is included in the purchase price. If unforeseen delays occur beyond the Seller’s control, the Seller will promptly notify the Buyer and provide updates on the delivery status.
The Seller will make every reasonable effort to arrange flatbed delivery with forklift assistance for unloading. However, the Buyer is solely responsible for securing a forklift or necessary equipment to unload and secure the Golf Cart upon delivery. The Seller will not provide unloading assistance. Failure to arrange proper unloading equipment may result in delivery delays, additional storage fees, or rescheduling costs, which will be the Buyer’s responsibility.
Delivery companies will make two attempts to deliver the Golf Cart. If the Buyer fails to be available, does not coordinate with the delivery team, or is unable to receive the shipment, additional costs may be incurred, including storage fees and the cost of subsequent delivery attempts. These costs will be the responsibility of the Buyer.
Neither party shall be liable for delays caused by natural disasters, acts of government, strikes, or other unforeseeable circumstances beyond their reasonable control.
4. Title and Risk of Loss
Title and risk of loss transfer from the Seller to the Buyer upon delivery and full payment of the purchase price.
5. Warranties
The Seller provides the following warranties for the Golf Cart:
General Warranty: A one-year warranty covering all parts of the Golf Cart from the date of delivery.
Extended Battery Warranty: A two-year extended warranty specifically covering the battery of the Golf Cart.
6. Return and Refund Policy
Return Policy: Upon delivery, the Buyer must inspect the Golf Cart within 48 hours. If any damages or discrepancies are found, the Buyer must notify the Seller in writing within this timeframe. Failure to do so will be considered acceptance of the delivery in its current condition. The Buyer may return the Golf Cart within 7 days if it does not match the agreed specifications. The Buyer is responsible for covering all return shipping costs to the Seller’s designated distribution center.
Refund Policy: A full refund of the purchase price, excluding delivery costs, will be issued upon return of the Golf Cart in its original condition. Refunds will be processed within 14 business days via bank transfer.
7. Dispute Resolution
The parties agree to resolve disputes through binding arbitration under the American Arbitration Association (AAA). The arbitration shall be held in Oklahoma City, Oklahoma, and each party shall bear its own legal fees.
8. Cancellation
This Agreement may be canceled by either party without penalty within 14 days following the completion of this contract. Cancellations made after this period may incur penalties.
9. Governing Law
This Agreement is governed by the laws of the State of Oklahoma.
10. Miscellaneous
This document represents the entire agreement between the parties. Any amendments must be in writing and signed by both parties.
